GALVESTON, Texas (CN) – An 80-year-old woman sued one of her sons, saying he swiped her house from under her, claiming it as “compensation” for losing two vehicles to his siblings.
Lydia Gracia sued Joseph Gracia in Galveston County Court.
Gracia claims that when she tried to pay her 2012 property taxes at the Galveston County Annex in Texas City “she was informed that her son … was the new owner of her homestead property.”
The complaint states: “Plaintiff confronted her son about her home and was told by defendant that his siblings were responsible for his loss of two of his vehicles and that he took plaintiff’s home as his compensation for his loss of said vehicles.
“Defendant informed plaintiff that he signed the deed conveying her homestead property to him on October 7, 2011. Plaintiff informed defendant that she had not knowingly nor intentionally conveyed her home to the defendant.
“Despite plaintiff’s repeated requests to return her home to her, defendant has refused to do so.”
Gracia claims that after she complained to an adult protection agency and police, Joseph reconveyed her house to her.
She wants up to $250,000 in punitive damages and a declaration that Joseph “procured the deed by fraud.”
She is represented by Carlos Garza with Martin, Garza & Fisher.
The complaint does not state what, if anything, became of her son’s cars
